Terms of sale
Translation for information. The French version is the only binding one and prevails in case of difference.
These terms apply to any purchase of an analysis pack on humain-ou-ia.fr. They complement the terms of use, which remain applicable to the use of the service.
1. Seller
Sébastien Necca SAS, French simplified joint-stock company with a share capital of €500, 55 chemin des Carrières, 73420 Voglans, France. SIREN 950 933 911, Chambéry Trade and Companies Register. EU VAT number FR26950933911. Contact: contact@humain-ou-ia.fr.
2. Offers
Packs give a number of credits shown on the Pricing page. One credit allows one analysis of a music file (the first 10 minutes are analysed), with verdict, details per element, timeline and PDF report. Credits can be used for 12 months from purchase; credits not used by then are lost. The free analyses of the period are always used before the credits. Spoken voice analysis, in beta, does not use any credit.
3. Prices
Prices are shown in euros including all taxes, 20% French VAT included. The applicable price is the one displayed at the time of the order.
4. Order and payment
Orders are placed from the Pricing page. Card payment is processed by Stripe Payments Europe Ltd; we never have access to your bank details. The sale is concluded when the payment is accepted. An invoice is sent automatically to the email address given at payment.
5. Delivery of credits
As soon as the payment is accepted, a credit code is displayed on screen and appears on the invoice. This code is personal: anyone who knows it can use the credits. If you lose it, write to us from the address used for the purchase.
6. Right of withdrawal
If you are a consumer, you have 14 days from the purchase to withdraw, without giving any reason, by writing to contact@humain-ou-ia.fr. If no credit has been used, you are refunded in full within 14 days, by the same means of payment.
By using a first credit before the end of this period, you expressly request the immediate performance of the service and acknowledge that you lose your right of withdrawal, in accordance with Article L221-28 of the French Consumer Code.
7. Failed analyses
If an analysis cannot be completed (unreadable file, technical error), the corresponding credit is returned automatically.
8. Nature of the results and liability
The results are statistical estimates produced by automatic models. They can be wrong, in either direction, and constitute neither proof nor an expert opinion (see the Reliability page). The seller undertakes to provide the service with care, under a best-efforts obligation. For business customers, its liability is limited to the amount paid for the pack concerned. For consumers, the statutory guarantees apply.
9. Statutory guarantee of conformity
Consumers benefit from the statutory guarantee of conformity of digital content and services provided for in Articles L224-25-12 et seq. of the French Consumer Code. In the event of a lack of conformity, write to us: we will restore the service, return the credits concerned or refund you.
10. Personal data
The data needed for the sale (email, billing address, VAT number where applicable, credit code) is processed in accordance with the privacy policy.
11. Complaints and mediation
For any complaint, write to contact@humain-ou-ia.fr; we reply within 7 days. If your complaint is not resolved, you can use a consumer mediator free of charge, whose details will be given here when sales open.
12. Governing law
These terms are governed by French law. Failing an amicable agreement, the competent courts are those within the jurisdiction of the seller's registered office, subject to the protective rules applicable to consumers.
